All work is performed subject to a written contract or proposal agreed upon by both parties prior to the start of any project. The scope, timeline, and pricing described in that written agreement govern each individual project. These Terms and Conditions apply broadly and are supplemented by - not replaced by - the project-specific agreement.
Estimates provided by KC Imperial Beach Deck & Fence are based on the information available at the time of the estimate, including an on-site assessment of your property where applicable. Estimates are not binding contracts. A final written proposal or contract will be provided before work begins.
Pricing may change if the scope of work changes after a proposal is signed, if unforeseen conditions are discovered during construction (such as hidden structural damage or utility conflicts), or if material costs change significantly between the date of estimate and the start of construction. Any changes to the agreed price will be communicated to you in writing before additional work is performed.
Permit fees are typically included in our proposals but are subject to the actual amounts charged by the relevant city or county at the time of application.
Project start dates are estimates based on our current workload and permit timelines at the time a contract is signed. We will keep you informed of your project schedule and notify you promptly of any changes.
If you need to cancel or reschedule a project, please notify us as soon as possible in writing. Cancellation terms - including any deposits or fees that may be retained - are specified in your project contract. Work that has already been performed or materials that have already been ordered may not be refundable.
We reserve the right to delay or reschedule work due to weather conditions, permit delays, material availability, or other circumstances beyond our control. We will notify you of any such delays promptly.
Payment terms are established in each project contract. Typical arrangements include a deposit at the time of contract signing, progress payments during construction, and a final payment upon project completion. Specific amounts and due dates will be stated in your written agreement.
Invoices are due upon receipt unless otherwise specified in the project contract. Payments not received by the due date may result in a delay or suspension of work until the outstanding balance is resolved. We reserve the right to charge a late fee on overdue balances as specified in your contract.
We accept payment by check, bank transfer, or other methods agreed upon in writing. Cash payments are accepted only as specified in the project contract.
Where required by law, KC Imperial Beach Deck & Fence will apply for and obtain the necessary building permits before construction begins. The cost of permits is included in or added to the project proposal. You are responsible for disclosing any known HOA requirements, deed restrictions, or easements affecting your property before work begins. Delays caused by HOA approval processes or undisclosed property restrictions are not the responsibility of KC Imperial Beach Deck & Fence.
KC Imperial Beach Deck & Fence warrants that all work will be performed in a workmanlike manner consistent with industry standards and applicable building codes. Specific warranty terms - including duration and what is covered - are stated in your project contract.
Manufacturer warranties on materials (such as composite decking or vinyl fencing) are separate from our labor warranty and are governed by the terms of the respective manufacturer. We will provide you with any applicable manufacturer warranty documentation upon project completion.
Warranties do not cover damage caused by misuse, neglect, modification by others, acts of nature, or normal wear and tear.
To the fullest extent permitted by applicable law, KC Imperial Beach Deck & Fence shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to our services or your use of our website. Our total liability for any claim arising out of a specific project shall not exceed the total amount paid by you for that project.
This limitation does not apply to damages caused by our gross negligence or intentional misconduct.
